Anyone who knows they are going to do something that would be a Federal or State crime of fraud or identity theft is guilty of a Federal crime. Also, one who "creates or arranges for the creation of a website or domain name that represents itself as a legitimate online business, without the permission or approval of the registered owner of the actual website or domain name of the legitimate online business, and uses that website or domain name, shall be fined under this title or sent to prison for up to five years, or both."
